To avail the products and services offered at www.holmstory.com (hereinafter referred to as “Website”) by HOLM STORY (hereinafter referred to as “HOLM STORY), the users of the Website (hereinafter referred to as “You” or “Your”) must agree to the following terms and conditions (hereinafter referred to as “Terms”). If You visit or shop or browse on the Website, You accept these Terms and Conditions. If You disagree with any part of the Terms and Conditions or/and Privacy Policy (please refer to Privacy Policy), please do not use our Website. Please review our Privacy Policy, which also governs your visit to www.holmstory.com, to fully understand our practices. Www.holmstory.com is a property of HOLM STORY LLP, pursuant to section 12(1) of the Limited Liability Partnership Act 2008 having its registered office at 5 Osho Drive, Gadaipur Mandi Road, Mehrauli, New Delhi - 110030.

1. Use of the Website

You may use the Website only for your own non-commercial personal use and in compliance with these Terms. You are responsible for your own communications, including the transmission, uploading or posting of information to the Website and are responsible for the consequences of such communications. Any other use of the Website requires the prior written consent of HOLM STORY You may not otherwise copy, modify, or distribute the contents of this Website without the prior written consent of HOLM STORY. You may not modify, publish, transmit, participate in the transfer of, sell, create derivative works from, or in any way exploit any of the content found on the Website, in whole or in part.

HOLM STORY requires You to agree not to use the Website, and specifically prohibit any use of the Website, for any of the following purposes:

1. Posting, communicating or transmitting any material that infringes on any intellectual property, publicity or privacy right of another person or entity;
2. Posting any information which is untrue, inaccurate or not your own;
3. Engaging in conduct that would constitute a criminal offence or give rise to civil liability or otherwise violate any law or regulation;
4. Attempting to interfere in any way with the Website’s network security, or attempting to use the Website to gain unauthorised access to any other computer system; and
5. Using the Website to drop ship merchandise to third parties.

You agree to indemnify, hold harmless, and defend HOLM STORY, its parent, subsidiaries, divisions, and affiliates, and their respective partners, employees, agents and affiliates from any and all claims, liabilities, damages, costs and expenses of defence, including attorneys’ fees, in any way arising from or related to your illegal use of the Website, your violation of these Terms or the Privacy Policy, defamatory or infringing content posted to the Website by You, or Your violation of any law or the rights of a third party.

1. Notices and Electronic Communication

When You visit the Website or e-mail HOLM STORY, You are communicating with HOLM STORY electronically. By communicating with HOLM STORY, You consent to receive communication from HOLM STORY electronically. HOLM STORY will communicate with you by e-mail or by posting notices on the Website. You agree that all agreements, notices, disclosures, and other communications that HOLM STORY provides to You electronically satisfies any legal requirement that such communication be in writing.

1. Terms and Conditions are Binding on all Purchases
2. All orders are deemed offers for You to purchase our products or/and services. HOLM STORY may accept your offer by issuing a confirmatory e-mail and/or mobile confirmation of the products specified in Your order. HOLM STORY’s acceptance of each such offer is expressly subject to and conditioned on Your assent to these Terms and HOLM STORY's Privacy Policy.
3. HOLM STORY reserves the right, with or without prior notice, to do any one or more of the following:

(i) Limit the available quantity of or discontinue any product or service; 

(ii) Impose conditions on the honouring of any coupon, coupon code, promotional code,or other similar promotion;

(iii) Bar you from making or completing any or all sale transaction(s); and

(iv) Refuse to provide You with any product or service.

1. You agree that by placing an order on the Website, You are entering into a binding contract with HOLM STORY and agree to pay all charges and taxes that may be incurred by you or on your behalf through the Website, at the price(s) in effect when such charges are incurred including, without limitation, all shipping, taxes and handling charges.
2. Product Information and Inventory

Excluding any content that may be submitted by You from time to time, HOLM STORY strives to ensure that the information on the Website is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies, which HOLM STORY may correct without liability.

HOLM STORY also reserves the right to limit quantities purchased by You and to revise, suspend, or terminate an event or promotion at any time without notice (including after an order has been submitted or acknowledged). HOLM STORY does not guarantee that all products described on the Website will be available.

6.Payment

All payments must be received by HOLM STORY prior to shipment of Order. HOLM STORY partners with CC Avenue, Razorpay, Paytm and Google Pay who accepts payment by net banking, credit card & debit card.

7.Order Processing

1. Subject to Clause 7(b), orders received are usually processed within three Business Days.

For the purpose of this Terms, the term “Business Days” shall mean, a day not being a Saturday and Sunday, on which banks in India are open for normal banking business. 

b. HOLM STORY partners with reliable courier companies & is not responsible for any delay in deliveries by them. Although we will help you in case of delays by providing you the tracking number.

1. Shipping and Handling

Standard shipping is available on all other products, based on availability, and shall be charged in addition to the price of selected product. Such shipping fees shall be as displayed on product checkout. HOLM STORY does not ship any of its product outside India.

1. You acknowledge that shipping and delivery schedules are estimates only and cannot be guaranteed. HOLM STORY is not liable for any delays in shipments.**Title and risk of loss or damage will pass to You upon delivery of the Products from the carrier.

b.**Shop orders will ship within 3-5 (three to five) Business Days for all in-stock items. HOLM STORY will email Your tracking information as soon as possible.

9.Return of Products and Replacements

HOLM STORY offers a 30 (thirty) days replacement warranty for all products sold on its Website, under certain conditions mentioned here in below:

a.**You will notify HOLM STORY of any defect within 24 hours from the date of receipt of delivery of the products, provided such return is for reasons limited to damage during shipment, packaging defect, incomplete packaging, wrongly delivered or wrong product. Products should be returned in their original packaging to qualify for replacement. Shipping and handling charges for return of such defective products and replacement shall be borne by You.

b.**HOLM STORY shall not be held responsible and liable for variation of appearance or display of products on its Website.

c.**In the event that You fail to inform HOLM STORY within the stipulated time frame and condition set out in Clause 9(a), HOLM STORY reserves the right to accept or reject such replacement request at its sole discretion.

d.**HOLM STORY will replace the defective product depending upon the warranty of the product at no extra cost. HOLM STORY will try to replace the specific product ordered. However, HOLM STORY reserves the right to offer an alternate product in case the returned product is out of stock/out of production.

e.**You acknowledge that the return and replacement policy is not valid for certain products, including products sold during sale events, made to order products, custom made products.

10.Refund Policy

a.**You understand and acknowledge that all sales are final and

b.**That there shall not be refund of any payment under any event whatsoever except refusal for exchanged product / replacement product.

In the event that You do not want replacement of a defective Product(s) under Clause 9, HOLM STORY shall offer the refundable amount pending receiving the product and its approval of rejection in their warehouse.

1. Order Changes and Cancellation

Any product additions, quantity changes or specification changes made to accepted orders will be modified in the order details:

1. Orders once shipped, cannot be cancelled or changed. 
2. b. Orders placed during sale events, cannot be cancelled or changed.
3. HOLM STORY may, without liability, cancel any accepted order before shipment if there are other problems with the payment mode selected by You.
4. Prepaid Order, once placed can be cancelled within 24 hours. Post that order cancellation would not be acceptable

1. Errors, Inaccuracies And Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

In no case shall HOLM STORY, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

1. 15. Applicable Law and Dispute Resolution

The Policy herein shall be construed in accordance with and be governed by the laws of India. All disputes arising out of or/and relating to the Policy shall be subject to the exclusive jurisdiction of the Courts in Delhi.
